External Data Protection Officer (DPO)

Security and safety topics in companies are becoming more and more important. In addition to general topics such as technical safety or job safety, data protection must also be addressed (see yellow marking in the following diagram).

The "data protection" part is becoming increasingly important. Among other things, this is also due to the General Data Protection Regulation (GDPR), which imposes severe penalties for violations if this topic is not dealt with correctly.

If you have more than 20 employees in your company who regularly process personal data, you are even obliged to appoint a data protection officer (§38 sec. 1 BDSG). You are allowed to engage an external expert to take over this role. Our experts can provide the needed support.

Tasks of an external Data Protection Officer

External Data Protection Officer (DPO)

As an external data protection officer, we offer you practical and holistic data protection advice to ensure that legal requirements are met, especially when it comes to compliance with the General Data Protection Regulation and the Federal Data Protection Act (BDSG). By appointing our external data protection officers, you benefit from the advantage of integrating up-to-date, cross-sector know-how into your organization. We can minimize your expenses for planning, monitoring and controlling the implementation of necessary measures to ensure your specific requirements for processing personal data. As a result, costs are transparently presented and optimized.

We take a pragmatic approach to consulting that fulfils the legal requirements placed on your organization. This includes the obligations to provide evidence in the creation of prescribed documentation as well as the establishment of data protection-compliant processes to ensure legal compliance. This includes, among other things:

  • Compliance with and ensuring the appointment of a data protection officer for your organization or a group data protection officer for your group of companies.
  • Contact person for the data controller and employees on data protection issues
  • Providing practical advice to the data controller and employees
  • Monitoring compliance with data protection requirements when processing personal data
  • Compliance with and ensuring the right of data subjects to information, correction, deletion, restriction of processing as well as data portability and objection
  • Compliance with and ensuring the awareness and training of your employees
  • Complying with and ensuring the implementation of a data protection impact assessment
  • Creating and maintaining a record of processing activities
  • Compliance with and ensuring the legally compliant transfer of data to third parties
  • Complying with and ensuring data processing on behalf of third parties
  • Compliance with and assurance of information obligations towards data subjects
  • Compliance with and ensuring the reporting of data breaches to the supervisory authorities as well as to data subjects
  • Compliance with and assurance of legally required data transfer to third countries
  • Ensuring the implementation of necessary technical and organizational measures
  • If required, preparation of case-specific documents

Advantages of an external data protection officer

Small and medium-sized enterprises in particular make use of the services of an external data protection officer. This has the following advantages:

  • Reduced training costs for the company's own staff, which saves time and money.
  • Always up-to-date expert knowledge through continuous further training of the external DPO
  • Timely information on new and upcoming topics, e.g. ePrivacy regulation
  • Targeted and calculable deployment through a defined time budget
  • Higher acceptance among staff (especially in the case of upcoming changes) if the suggestions come from an external consultant
  • Fast implementation with less effort for required measures - due to practical experience and expert knowledge of the external data protection officer

If required, we will be happy to take on the role of external data protection officer for you.

If you are interested, we can also support you in the area of information security. If you come from an industry that requires the appointment of a Chief Information Security Officer (CISO), you can benefit from synergy effects by letting us perform both roles. We can offer you these synergy effects in the form of a lucrative inclusive package.

We would be happy to provide you with information in an initial free and non-binding consultation.
